Appsplit Terms of Service
Appsplit provides a marketplace for users interested in either starting a campaign (Principal) to fund, sell, or develop an app or those interested in contributing to such campaigns (Supporters) by funding, selling, or contributing to the development of apps. Collectively, members starting a campaign, those contributing to the campaigns, and visitors and contributors to the website are referred to as "Users". Users are bound by the terms and conditions herein and are responsible for reading and understanding the terms and conditions before using our services. Users who do not agree to be bound by these terms or future modifications as they become available may not use or access our services.
Appsplit reserves the right, at its sole discretion, to modify or replace the services provided and the terms and conditions of use at any time for any reason. Users are bound by any and all modifications and as such are advised to check Terms and Conditions regularly for any updates.
Users bound by our terms and conditions agree not to use our services for reasons prohibited by the terms and conditions set forth by Appsplit or by law. Users are responsible for all activity connected with their use of our services and as such shall not permit any third party users access or use of their accounts in a manner contrary to the terms and conditions of this agreement. Users are solely responsible for their interactions with other users. Appsplit reserves the right, but is under no obligation, to monitor disputes between users.
Users agree not to start a campaign, contribute to a campaign, or otherwise contribute to and access our services in a manner that:(i) infringes any patent, trademark, trade secret, copyright, right of publicity, or other right of any other person or entity, or violates any law or contract; (ii) provides inaccurate, misleading, or false information; (iii) is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, obscene, offensive, profane, or invasive of another's privacy; (iv) constitutes unsolicited or unauthorized advertising or promotional material or any junk mail, spam, or chain letters; (v)contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit, or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password, or other information of the Company or any third party; or (vi)impersonates any person or entity, including any employee or representative of Appsplit.
Additionally, a user shall not: (i) take any action that imposes or may impose (as determined by Appsplit in its sole discretion) an unreasonable or disproportionately large load on Appsplit's or its third-party providers’ infrastructure; (ii) interfere or attempt to interfere with the proper working of the Service or any activities conducted on the Service; (iii) bypass any measures the Company may use to prevent or restrict access to the Service (or other accounts, computer systems, or networks connected to the Service); (iv) run Maillist, Listserv, or any form of auto-responder or "spam" on the Service; or (v) use manual or automated software, devices, or other processes to "crawl" or "spider" any page of the Site.
A user shall not directly or indirectly: (i) decipher, decompile, disassemble, reverse engineer, or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of the Service, except to the limited extent applicable laws specifically prohibit such restriction; (ii) modify, translate, or otherwise create derivative works of any part of the Service; or (iii) copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national, and international laws and regulations.
Appsplit reserves the right to refuse or cancel services, temporarily or permanently, for any reason without prior notice. It is in Appsplit's sole discretion to determine if a user has violated the terms and conditions set forth. Violations may include but are not limited to (i) interfering with or compromising the security or integrity of the system; (ii) using our services for activities that are deemed unlawful or illegal; (iii) misrepresenting yourself or impersonating another user ; (iv) engaging in activities that are deemed hurtful to Appsplit , its founders, and its users.Fees
Users can join Appsplit for free. However, every campaign is associated with certain fees as is outlined in the campaign. By launching a campaign, the principal acknowledges the presence of these fees and accepts the fees associated with the launched campaign.
Fees and supporters' pledges are collected by Amazon Payments, PayPal, or both; Appsplit is not responsible for the performance of these third party entities and assumes no liability for any damage related to use of these (or other) third party services or websites.Campaigns
Appsplit is a marketplace where users create campaigns to fund, develop, and sell apps. Users participating in a campaign are bound by our Terms and Conditions and by their commitments within the campaign, including:(i) providing payment information and ensuring that sufficient funds are available to satisfy your pledged support of the campaign; (ii) providing payment to the user starting the campaign and Appsplit as is dictated by the nature of the campaign; (iii) providing rewards as is dictated in the campaign; (iv) understanding that the effective date for reward processing is an estimated fulfillment date subject to change; (v) accepting that fulfillment of some rewards will require the campaign principal to request additional information from supporters such as mailing address, email address, or size; (vi) accepting that Appsplit does not offer refunds and that all pledges are final unless the conditions of the campaign are such that funds are not processed if a campaign is not fully funded; (vi) acknowledging the assumption that campaign principals shall refund pledges to supporters in instances where a reward cannot be fulfilled as dictated by the campaign; (vii) Campaign Principals may cancel or refund funds to supporters in some instances as is dictated by the campaign; under such conditions, the principal is not required to fulfill the rewards; (viii) accepting that Appsplit cannot guarantee fullfillment of pledged support in cases where supporters fail to provide payment to satisfy their pledged support; (ix) accepting that Appsplit fees will be processed as is dictated in the campaign; (x) accepting that Appsplit reserves the right to cancel or reject a pledge or a campaign at any time for any reason without risk of liability for any damages as a result of such actions; (xi) accepting that Appsplit is not liable for any damages or loss assumed as a result of a campaign or use of our services. As such, Appsplit is under no obligation to become involved in disputes between users and users and any third party stemming from a campaign or use or our services. Appsplit and its founders, employees, agents, and successors are released from claims, damages, and demands of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising in relation to resolution of such disputes and any related services.Content and License
Our website and its content, including but not limited to all copyrights, trademarks, and other intellectual property rights therein, are owned by Appsplit. Users acknowledge that the Website and any underlying technology used in connection with it contain our intellectual property and proprietary information. Users shall not reproduce, sell, license, rent, or otherwise use or exploit any Content for commercial use or in any way that violates any third-party right.
Users are solely responsible for content that is uploaded, published, displayed, linked to or otherwise made available on the Website. Users must be the owner of all the Intellectual Property Rights in the User Content posted, or must have explicit permission from the owner(s) of all such rights to post the User Content on Appsplit. Users agree to not post content that contains any information or content that is illegal; (vi) contains any information or content that you do not have a right to make available under any law or under contractual or fiduciary relationships; or (vii) contains any information or content that you know is not correct and current. You agree that any User Content that you post does not and will not violate third-party rights of any kind, including without limitation any Intellectual Property Rights, rights of publicity and privacy. Appsplit reserves the right, but is not obligated, to reject and/or remove any User Content that is believed to violate these provisions. User's aware of any infringing or unlawful content are asked to notify Appsplit directly (firstname.lastname@example.org) with a detailed, sworn, and signed statement detailing the content and in what manner it is believed to be infringing or unlawful.
Users agree that Appsplit is not responsible and assumes no liability for any User Content that is posted on the website. Any loss or damage of any kind that occurs as a result of the use of any User Content that a user sends, uploads, downloads, streams, posts, transmits, displays, or otherwise makes available or accesses through the use of the Website, is solely the user's responsibility. Appsplit is not responsible for any public display or misuse of User Content. Users of our Website understand and acknowledge that they may be exposed to User Content that is inaccurate, offensive, indecent, or objectionable, and agree that Appsplit shall not be liable for any damages alleged to incur as a result of such User Content.
By posting content to our website, users are automatically granting Appsplit an irrevocable, perpetual, nonexclusive, royalty-free, worldwide license (i) to use, copy, perform, display and distribute said Content, (ii) to prepare derivative works of, or incorporate into other works, said Content and make uses under an equivalent license, and (iii) to grant and authorize sublicenses through multiple tiers of the foregoing. You also understand and agree that Appsplit, in its sole discretion, may delete any Content for any reason.
Any Content created using the Website shall be owned by us. For example, all copyrights in reviews, ratings, rankings, charts, blogs, forums, community pages, newsletters, broadcasts, XML, and RSS shall be owned by us and licensed to you and other users of the Website pursuant to the terms herein. The compilation of content comprising the Services and the Website are the exclusive property of Appsplit and are protected by U.S. and international copyright laws. To the extent ownership does not manifest for Appsplit in either the Content or any compilation thereof, you hereby grant us a license with equivalent rights to that of the Content you post on the Website.
You can remove your Content at any time by deleting your account. Deletion of your account will not terminate any Content licenses granted to us prior to deletion of your account, but we will no longer associate said Content on the Website with a deleted account.Indemnification
By using the Services, you consent to receive all communications including notices, agreements, legally required disclosures, or other information in connection with our Website and services electronically. Appsplit may provide the electronic Contract Notices by posting them on the Site. If you desire to withdraw your consent to receive Contract Notices electronically, you must discontinue your use of the Services.
Electronic Communications Privacy Act Notice (18 USC §2701-2711): THE COMPANY MAKES NO GUARANTY OF CONFIDENTIALITY OR PRIVACY OF ANY COMMUNICATION OR INFORMATION TRANSMITTED ON THE SITE OR ANY WEBSITE LINKED TO THE SITE. The Company will not be liable for the privacy of email addresses, registration and identification information, disk space, communications, confidential or trade-secret information, or any other Content stored on the Company’s equipment, transmitted over networks accessed by the Site, or otherwise connected with your use of the Service.
